The primary applicant is the skilled worker who must meet the main eligibility criteria for the grant of the Subclass 189 visa. Here is what is required:
You Must Have a Valid Invitation
You must have received a written invitation from the Australian Minister via SkillSelect before you can apply. SkillSelect will require an invitation code when you lodge your application. Family members making a combined application with you do not need their own invitation.
You Must Apply Within 60 Days
Your application must be submitted within the period specified in your invitation — this is no more than 60 calendar days from the date your invitation was issued in SkillSelect.
You Must Be Under 45 at the Time of Invitation
You must not have turned 45 years old at the time you were invited to apply. This is a strict requirement.
You Must Nominate a Skilled Occupation
Your nominated occupation must:
- Be on the official skilled occupation list at the time your invitation was issued
- Match the occupation specified in your invitation letter
- Be one for which you declare your skills have been assessed as suitable by the relevant assessing authority — and that assessment must not be for a Subclass 485 (Temporary Graduate) visa
The legislative instrument specifying skilled occupations is the Migration (LIN 19/051: Specification of Occupations and Assessing Authorities) Instrument 2019, and the applicable instrument is whichever was in force at the time your invitation was issued.
Your Nominated Occupation Cannot Be Changed After Lodgement
Once you have submitted your application, neither you nor the Minister can change the nominated occupation. There is no provision in the migration legislation that allows this. If you need to change your occupation, you must let your current invitation lapse, update your Expression of Interest (EOI) in SkillSelect, and wait for a new invitation under the new occupation.
