Logging into ImmiAccount to find your visa gone — with no warning email, no letter, nothing — is one of the most disorienting experiences a visa holder can face. The short answer: in most cases you're legally entitled to notice, but there are important exceptions where a visa cancelled without notice is entirely lawful.
The General Rule vs. The Exception
For most cancellations, the Department of Home Affairs must issue a Notice of Intention to Consider Cancellation (NOICC) before acting — giving you a window, often 28 days but sometimes far shorter, to respond. This is the standard process for a Section 116 visa cancellation, which covers breached conditions, changed circumstances, or false information.
But automatic visa cancellation in Australia does happen without that warning in specific situations:
- Mandatory cancellation under Section 501 — if you're serving a prison sentence of 12 months or more, your visa can be cancelled automatically while you're in custody, sometimes with no prior notice at all
- National interest grounds — the Minister can personally cancel a visa without notice if advance warning is considered contrary to Australia's interests
- Visa cancelled while overseas — cancellation can occur while you're outside Australia, and notification may go to an old address, an unchecked inbox, or simply never reach you in time
Is Australia Required to Notify You?
Is Australia required to notify visa cancellation decisions? Generally yes — but "notify" doesn't always mean "reach you in a way you'll actually see." The Department may consider a notice properly given once it's sent to your last recorded address or email, even if you never open it. This is exactly how many people end up asking why was my visa cancelled long after the fact.
What If I Don't Know My Visa Was Cancelled?
What happens if my visa is cancelled and I don't know varies depending on where you are:
- Onshore — you become an unlawful non-citizen immediately, risking detention or removal, even unknowingly
- Offshore — you may only discover the cancellation when attempting to board a flight or apply for another visa
