In short: A Notice of Intention to Consider Cancellation (NOICC) is not a cancellation — it's a warning and your chance to respond before one happens. Under the Migration Act 1958, you'll typically have 5 working days to reply, though this can extend to 14 or 28 days depending on the ground. Miss it, and a delegate can cancel your visa based only on the information already on file.

What Is a NOICC in Australia?

A notice of intention to consider cancellation is a formal letter from the Department of Home Affairs setting out why your visa may be cancelled — a breached condition, incorrect information, or a ground under the Migration Act 1958 no longer being met. It's a procedural fairness step: before cancelling, the Department must give you an opportunity to explain yourself. That opportunity is the entire point of the NOICC response process.

How Long Do I Have to Respond to a NOICC?

This is the detail that trips people up most. Timeframes vary by ground:

  • Most general cancellations: 5 working days from deemed receipt
  • Incorrect information (Section 107): 14 days, with no option to extend
  • Offshore notifications: commonly up to 28 days

A NOICC extension of time can sometimes be requested in limited circumstances, but it is never guaranteed — the safest assumption is that the date on your letter is final.

Steps After Receiving a NOICC

  1. Read the notice carefully — identify the exact section of the Migration Act cited and the deadline
  2. Gather evidence addressing every concern raised, not just the main one
  3. Address hardship and compliance history — the delegate weighs your immigration record, purpose of stay, and potential hardship
  4. Submit in writing, in English, before the deadline — silence is treated as having nothing to say
  5. Keep proof of submission in case of later dispute

🚫 Don't Wait Until the Deadline Is Close

A strong NOICC response is built on evidence, not urgency. Book a consultation now so there's time to build yours properly.

What Happens If I Don't Respond to a NOICC?

If you don't reply, a delegate of the Minister can proceed to cancel your visa using only the information already held by the Department — meaning your side of the story is never considered. This is the single most avoidable reason visas are cancelled.

What Happens If My Visa Is Cancelled After NOICC?

Once a delegate makes a written record of cancellation, the decision is final and cannot be varied by that delegate. You immediately become an unlawful non-citizen after visa cancellation, which carries mandatory detention and removal risk. Any bridging visa associated with a pending application also ceases at the same time.

Can a Cancelled Visa Be Reviewed?

Generally, yes. If you were in Australia and immigration cleared when the cancellation happened, you can usually seek a NOICC ART review — a merits review by the Administrative Review Tribunal. Deadlines here are just as strict:

  • 7 working days for general cancellations
  • 9 days for character-related grounds

If the ART sets the cancellation aside, your visa is treated as if it was never cancelled at all — which is why a well-prepared review application matters as much as the original NOICC response.

Do I Need a Migration Agent for a NOICC?

You're not required to have one, but migration agent NOICC help typically means every ground is addressed point by point, with the right evidence attached the first time — because there is rarely a second chance. At Edvise Hub, we help clients interpret their NOICC, build an evidence-based response, and prepare for ART review if it becomes necessary.
