  • Character test visa cancellation (Section 501) — reserved for character grounds, usually tied to criminal convictions or associations, and carries far higher stakes and much tighter deadlines.

How Long Do I Have to Appeal a Visa Cancellation?

This is the one detail that ends cases before they start. Time limits are set out in the Migration Regulations and stated on your cancellation letter — always confirm the exact figure there, because it varies by circumstance:

  1. Section 116 cancellations (not in detention): typically 21–28 days from notification.
  2. Section 116 cancellations (in immigration detention): often just 7 working days.
  3. Section 501 character cancellations: commonly as little as 9 days, and for mandatory cancellations under s501(3A) you must first request Ministerial revocation before any ART review is available.

The Administrative Review Tribunal has almost no power to extend these deadlines. A late application is, in most cases, a lost one

The ART Appeal Process for Cancelled Visas

Once validly lodged, an Administrative Review Tribunal appeal runs through four stages: lodgement (application plus fee, within the deadline), evidence gathering (the Tribunal obtains the Department's file while you prepare submissions and supporting evidence), a hearing (in person, phone, or video, where you or your representative present the case), and a decision — the ART can affirm the cancellation, set it aside and restore your visa, or remit the matter back to the Department.
