In short: Yes, most visa cancellation decisions can be appealed to the Administrative Review Tribunal (ART), which replaced the AAT in October 2024. The ART conducts a fresh merits review of your case, but deadlines are strict, generally cannot be extended, and run from the date the decision is deemed notified — not the day you actually read the letter.

Receiving a cancellation notice is stressful enough. What makes it worse is discovering how little room there is to get an appeal wrong. The ART reviews your case from scratch, which is good news if your original decision was flawed — but only if you lodge correctly, on time, with the right evidence attached.

What The ART Actually Does

The Administrative Review Tribunal is Australia's independent merits review body, replacing the former Administrative Appeals Tribunal in October 2024. Rather than simply checking the Department's paperwork, the ART steps into the shoes of the original decision-maker and reconsiders your case on the facts and the law as they stand now. It can affirm the cancellation, set it aside, or send the matter back to the Department with directions.

How The Appeal Deadline Works

This is the single most important detail in any cancellation appeal. Deadlines are calculated in calendar days from the date your decision is deemed notified under the Migration Regulations 1994, and for most migration categories, the Tribunal has no power to extend them. Depending on the visa type and cancellation section involved, this window can be as short as 7 working days for those in immigration detention, or up to 28 days for other matters. Missing it generally means losing your right to review altogether.

What's Changed Recently

Newer ART Practice Directions took effect from March 2026, introducing stricter case management and timetabling. Separate legislative amendments are also expanding the range of matters the Tribunal can decide entirely on written submissions, without an oral hearing — which makes the strength of your initial evidence package more important than ever, rather than something to fill in later.

What Isn't Reviewable

Not every cancellation goes to the ART. Some Section 501 character cancellations made personally by the Minister sit outside the Tribunal's jurisdiction. In these cases, the main avenue is requesting the Minister to revoke the cancellation directly, rather than a Tribunal appeal.

Building A Stronger Case

Because fresh evidence is admissible at the ART, a well-prepared appeal usually includes updated statements, supporting documents, and a clear response to each ground cited in your cancellation notice. At Edvise Hub, we help clients pull this evidence together early, so the appeal reflects the strongest possible version of their case from the very first submission.

Frequently Asked Questions

What replaced the AAT for visa appeals?

The Administrative Review Tribunal (ART), which began operating on 14 October 2024 and now handles migration merits reviews.

Can the ART deadline be extended?

Generally no. For most migration matters, the Tribunal cannot extend the review deadline once it passes.

Are all visa cancellations reviewable at the ART?

No. Certain Section 501 cancellations made personally by the Minister fall outside the ART's jurisdiction and instead require a request for ministerial revocation.
